We are NOT a party to any sale, purchase, trade, lease, or transport arrangement between users. Every transaction is strictly peer-to-peer between the seller and the buyer, AT THE SOLE RISK OF THE BUYER AND SELLER.

MyBarnBridge.com does NOT act as an agent, broker, dealer, market agency, commission merchant, order buyer, auctioneer, packer, or intermediary in the sale of livestock. To the extent the Packers and Stockyards Act, 7 U.S.C. § 181 et seq., or any state livestock dealer, market agency, brand, or auctioneer licensing law governs persons who buy, sell, broker, or handle livestock or livestock proceeds, MyBarnBridge.com does not perform those activities and does not assume those duties.

2. No Ownership, Possession, or Handling of Proceeds

• MyBarnBridge.com never takes title, ownership, custody, possession, or control of any animal.
• MyBarnBridge.com never handles, processes, holds, escrows, collects, remits, or facilitates payment or proceeds for any livestock sale.
• All livestock payments, transport, delivery, and transfer of ownership occur directly between buyer and seller, off the Site.
• Fees paid to MyBarnBridge.com are for platform access and promotional placement only, never for the sale of an animal and never as commission or proceeds.

3. Absolute Liability Waiver and 'As-Is' Disclaimer for Livestock

MYBARNBRIDGE.COM IS AN ADVERTISING VENUE ONLY. WE DO NOT INSPECT LIVESTOCK, VERIFY THE HEALTH OF ANY ANIMAL, OR GUARANTEE THE ACCURACY OF ANY LISTING. ALL TRANSACTIONS, COMMUNICATIONS, INSPECTIONS, PAYMENTS, TRANSPORT, AND TRANSFERS ARRANGED THROUGH THE SITE ARE AT THE USER'S OWN RISK AND ARE STRICTLY 'AS-IS, WHERE-IS, WITH ALL FAULTS.'

MYBARNBRIDGE.COM MAKES NO WARRANTY OR REPRESENTATION OF ANY KIND, EXPRESS OR IMPLIED, ABOUT THE HEALTH, SOUNDNESS, DISEASE STATUS, TEMPERAMENT, FERTILITY, PREGNANCY, PEDIGREE, REGISTRATION, AGE, BREED, SEX, WEIGHT, QUALITY, PERFORMANCE, SUITABILITY FOR ANY PURPOSE, TITLE, OWNERSHIP, LEGALITY, PROVENANCE, OR CONDITION OF ANY ANIMAL LISTED ON THE SITE.

We do not inspect, examine, test, weigh, grade, appraise, verify, transport, house, feed, or care for any animal. We do not verify the identity, honesty, solvency, licensing, or authority of any user, nor the accuracy or completeness of any listing, photo, video, or statement. Everything is offered by its seller AS-IS, WHERE-IS, WITH ALL FAULTS.

4. Site Provided As-Is

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, SECURE, OR ERROR-FREE OPERATION.

Nothing on MyBarnBridge.com — including guides, articles, checklists, or support responses — is veterinary, legal, tax, financial, or regulatory advice. Consult your own licensed veterinarian, attorney, accountant, brand inspector, or state department of agriculture before buying, selling, or moving animals.

6. Featured Listings Are Advertising Only

A Featured Listing is paid promotional placement and visibility only. It is not an endorsement, verification, vetting, certification, guarantee, or insurance of the seller, the buyer, the animal, the equipment, the description, the price, or the completion of any sale. Purchasing a Featured Listing creates no agency relationship, no duty of care regarding the underlying sale, and no guarantee of views, inquiries, offers, or a sale.

7. Regulatory Compliance Indemnification

By listing, bidding on, purchasing, selling, or arranging the movement of any animal through the Site, you represent, warrant, and covenant that you have obtained, or will obtain before movement, all legally required Certificates of Veterinary Inspection (CVIs/health certificates), negative disease test results, official identification, permits, tags, brand inspection certificates, and any other documentation required by the state, tribe, territory, or country of origin, destination, or transit.

• Sellers warrant that all required health papers, test results, and brand inspection certificates are in hand, current, and accurate before the animal is offered for sale or moved.
• Buyers warrant that they have confirmed and will satisfy their own state's entry, permit, testing, identification, and quarantine requirements before the animal moves.
• Both parties warrant that the movement, sale, and transfer comply with all applicable federal, state, tribal, and local animal health, movement, identification, brand, welfare, and sales laws.

You agree to indemnify and hold harmless MyBarnBridge.com for any claim, fine, penalty, loss, liability, or expense arising from your failure to obtain, maintain, or comply with any such legal requirement.

8. Zero Financial Mediation

MyBarnBridge.com does NOT handle, process, hold, escrow, collect, remit, or facilitate payment or proceeds for any livestock sale, purchase, or transaction. All payments for animals occur directly between buyer and seller, outside the Site, through methods and arrangements chosen solely by the users.

MyBarnBridge.com does NOT offer fraud protection, payment guarantees, buyer protection, seller protection, escrow services, chargeback assistance, or dispute resolution for any transaction between users. If a buyer is scammed, a check bounces, a payment fails, a seller does not deliver, or any other payment-related dispute arises, MyBarnBridge.com will not be held responsible and cannot be pulled into the dispute. Your sole recourse is against the other user.

9. Forbidden Listings and Compliance

The following livestock listings and content are strictly forbidden on MyBarnBridge.com:

• Sick, injured, diseased, or disabled animals offered for sale without clear, conspicuous, and truthful disclosure of the condition.
• Animals that are subject to a quarantine, hold order, positive disease test, or government restriction on movement or sale.
• Protected exotic species, endangered species, or any animal whose sale or possession is prohibited by federal, state, tribal, or local law.
• Animals offered for illegal fighting, baiting, research, or any unlawful purpose.
• Listings that promote animal cruelty, neglect, or unlawful veterinary drug or hormone use.
• Stolen animals, or animals offered by a person without legal authority to sell.

We reserve the right, at our sole discretion and without notice, to refuse, edit, or remove any listing or content, suspend or terminate any account, and ban any user. We may cooperate with law enforcement, brand inspectors, animal health authorities, and regulatory agencies.

10. User-Generated Content (UGC) Indemnity

You retain ownership of the photos, videos, text, logos, and other content you post. By posting content, you grant MyBarnBridge.com a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, adapt, display, distribute, and promote that content in connection with operating, marketing, and improving the Site.

You represent and warrant that you own all right, title, and interest in your content, or have obtained all necessary licenses, releases, consents, and permissions to post it; that your content does not infringe any third-party copyright, trademark, trade secret, publicity, privacy, or other right; and that your content is truthful and not misleading.

You agree to indemnify and hold harmless MyBarnBridge.com from any claim, loss, liability, or expense — including reasonable attorneys' fees — arising out of or related to any allegation that your content infringes a third party's rights, contains stolen photos or breed logos, is defamatory, deceptive, or otherwise unlawful.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MYBARNBRIDGE.COM AND ITS OWNERS, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OPERATORS, AGENTS, AND AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, LIVESTOCK, HERD VALUE, GENETICS, BUSINESS, GOODWILL, OR DATA.

We are specifically not responsible for:

• Disease transmission, contagion, contamination, quarantine, herd loss, depopulation, injury, sickness, or death of any animal.
• Fraud, misrepresentation, nonpayment, fraudulent payment, failure to deliver or to accept delivery, or breach of contract by any user.
• Title defects, liens, stolen property, brand disputes, or registration and pedigree problems.
• Personal injury or property damage caused by any animal or item of equipment.
• Transport, hauling, loading, handling, or delivery of any animal or item.
• Failure to obtain or honor CVIs, testing, permits, tags, or other legal requirements.
• User content, third-party services, payment processor failures, downtime, data loss, or security incidents.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO MYBARNBRIDGE.COM IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE PLACES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Release and Indemnification

You release MyBarnBridge.com and its owners, operators, and affiliates from all claims arising out of any dispute with another user, and you agree to defend, indemnify, and hold them harmless from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your listings, your conduct, your transactions, the health or title of any animal or item you list or acquire, or your violation of these documents or of any law.

13. Arbitration, Governing Law, and Severability

Disputes with MyBarnBridge.com are resolved by binding individual arbitration with a class action and jury trial waiver, as set out in the Terms of Service. These documents are governed by the laws of the State of [Governing State]. If any provision is held unenforceable, it will be modified or severed and the remainder stays in effect.
